How Is Spousal Support Awarded?

In Virginia, “alimony” or “spousal maintenance” is called spousal support. Spousal support is granted to a spouse who is less financially independent than the other spouse. These payments can help reduce the financial impact that a divorce will have on the spouse who is awarded spousal support and may help to support a lifestyle similar to what they were used to during the course of the marriage.

Many factors are often taken into consideration regarding the awarding of spousal support, including:

  • The duration of the marriage
  • The potential to earn income
  • The earning capacity of the spouses during the marriage
  • Contributions during the marriage, including who was the homemaker and who was the main source of income
  • Assets and debt
  • Living standards and history set in the marriage

Spousal support is not required to finalize a divorce, but a court may consider awarding spousal support in certain circumstances in addition to awarding a divorce. If a spouse is awarded spousal support, the support may come in periodic payments, or it may be ordered as an up-front, lump sum payment.
