Fairfax Military Divorce Attorneys
Ready to Handle All Aspects of a Military Divorce
Since 1982, the Law Offices of Michael Kevin Murphy, PLLC has represented active duty and retired service members and their spouses in military divorce actions in Northern Virginia. Military divorce follows the same process as a civil divorce but has added complexities due to the service obligations of the parties and the military benefits that must be taken into account. The firm handles all aspects of divorce, including child support, custody and visitation, spousal support, and division of property including retirement and survivor benefits. We manage contested and uncontested divorces, using traditional negotiation, mediation, collaborative team divorce, and courtroom litigation. Because of our longtime association with the United States military, we understand the special challenges of service members and their spouses, as well as the special requirements for military asset division in divorces.
Few lawyers have embraced technology the way we have. We use creative and innovative ways to help our local and forward-deployed military clients with their cases and save them money. Our lawyers and staff members will interact frequently with our current and prospective military clients via “Zoom”, “Facetime”, “Cisco Webex”, “Skype”, or other means of video teleconferencing. Setting up a video teleconference with one of our attorneys for an initial client consultation is easy. Just give us a call or send us an email and we’ll make it happen.

If you are (i) a military member who has been assigned to military duty in the Washington, D.C. Metropolitan Area or (ii) a spouse of that military member, and (iii) at least one of the spouses has resided in Virginia for at least six months and continues to reside here, either spouse may file for divorce and also have child custody, spousal and child support, and division of marital property determined by a Virginia circuit court. Also, it does not matter at all if the military member claims a state other than Virginia as his or her residence because under Virginia law its circuit courts have all the required jurisdiction to do these things. Also, if the parties last lived together as spouses in Virginia and the military member is deployed or reassigned overseas, so long as the other spouse remains living in Virginia as provided above the Virginia circuit courts retain that jurisdiction.
The Law Offices of Michael Kevin Murphy, PLLC manages divorce proceedings for active duty, former, and retired service members and their spouses in all branches of the military. If you are considering divorce in Fairfax, Prince William, Loudoun, Arlington, and Stafford Counties and the City of Alexandria in Northern Virginia regardless of where you are currently stationed, our military divorce attorneys in Fairfax can help.

Children returned and Assets retained… enough said!
I retained Mike and Rebecca to represent me in what even the presiding judge admitted was one of the most complex cases he'd ever seen. Basically, my ex spouse manufactured allegations against me which she used to remove our minor children from the Commonwealth to return to her home state without my knowledge or consent. I had to fight tooth and nail to try and clear my name and get my kids back. Well, Mike and Rebecca did just that. They met every legal challenge professionally and with decisions that were in the best interest of the children. The result is that ALL of the children have been returned home to Virginia with me having primary custody AND I retained ALL of my assets. Note: I am also a lawyer who knows great legal work...this is such a case. The best interest of the child(ren) is THE standard.
Without his guidance and representation I am confident that I would be lost and without my children.
“I could not be more grateful to Mike for what he has done for me and my family.”
Your validation has pulled his life out of quicksand.
“You've given him hope and thoughts of a productive future. He has reason to persevere.”
I want to thank you for your wise counsel and words of encouragement over the last 18 months.
“It was an ordeal for me, but your assistance undoubtedly made it easier. ”
There is probably only a handful of attorneys of his experience and caliber.
“His practice is almost fully electronic, which keeps costs down and enables him to help military families even stationed overseas.”
It is not only the legal work – but the feeling of protection, understanding, and caring that sets you apart.
“I thank you both for bolstering me up and looking out for me when I needed it most.”
I was blessed to have you and your team to represent me, it was worth every penny!
“You all showed that you had my needs and desires at the forefront. ”
Mike Murphy and his team helped me negotiate a very favorable divorce settlement.
“Mike Murphy and his team helped me negotiate a very favorable divorce settlement. Their advice and counsel allowed me to keep 100% of my military pension, sole ownership of my two homes, and helped reduce my spousal support payments from seven years to five. I never dreamed a settlement this favorable was possible, but Mike and his team made it a reality.”
