Fairfax Military Divorce Attorneys

Ready to Handle All Aspects of a Military Divorce

Since 1982, the Law Offices of Michael Kevin Murphy, PLLC has represented active duty and retired service members and their spouses in military divorce actions in Northern Virginia. Military divorce follows the same process as a civil divorce but has added complexities due to the service obligations of the parties and the military benefits that must be taken into account. The firm handles all aspects of divorce, including child supportcustody and visitationspousal support, and division of property including retirement and survivor benefits. We manage contested and uncontested divorces, using traditional negotiation, mediation, collaborative team divorce, and courtroom litigation. Because of our longtime association with the United States military, we understand the special challenges of service members and their spouses, as well as the special requirements for military asset division in divorces.

Few lawyers have embraced technology the way we have. We use creative and innovative ways to help our local and forward-deployed military clients with their cases and save them money. Our lawyers and staff members will interact frequently with our current and prospective military clients via “Zoom”, “Facetime”, “Cisco Webex”, “Skype”, or other means of video teleconferencing. Setting up a video teleconference with one of our attorneys for an initial client consultation is easy. Just give us a call or send us an email and we’ll make it happen.

If you are (i) a military member who has been assigned to military duty in the Washington, D.C. Metropolitan Area or (ii) a spouse of that military member, and (iii) at least one of the spouses has resided in Virginia for at least six months and continues to reside here, either spouse may file for divorce and also have child custody, spousal and child support, and division of marital property determined by a Virginia circuit court. Also, it does not matter at all if the military member claims a state other than Virginia as his or her residence because under Virginia law its circuit courts have all the required jurisdiction to do these things.  Also, if the parties last lived together as spouses in Virginia and the military member is deployed or reassigned overseas, so long as the other spouse remains living in Virginia as provided above the Virginia circuit courts retain that jurisdiction.

The Law Offices of Michael Kevin Murphy, PLLC manages divorce proceedings for active duty, former, and retired service members and their spouses in all branches of the military. If you are considering divorce in Fairfax, Prince William, Loudoun, Arlington, and Stafford Counties and the City of Alexandria in Northern Virginia regardless of where you are currently stationed, our military divorce attorneys in Fairfax can help.
