Michael Kevin Murphy is a graduate of the Virginia Military Institute and former U.S. Army officer who served with distinction, having been awarded the Combat Infantryman’s Badge, Parachutist Wings, Ranger Badge, Bronze Star Medal, and eight Air Medals, and his own military unit during combat service received the Valorous Unit Award. For many years he has served the divorce and family law needs of our nation’s military and other government professionals and their spouses with his unique military and family law background. From our main office adjacent to the Courthouse in Fairfax, VA, Mr. Murphy is also available to serve as an expert witness, associate with other attorneys throughout the United States, and is available to consult with other attorneys who would rely upon his experience in dealing with these special family law needs. Mr. Murphy is known throughout Northern Virginia for his strategic planning for our clients’ best interests, exhaustive trial preparation, and powerful in-court representation.

 

Negotiation, Mediation, and Collaborative Practice of Law

While litigation is very much a part of my practice and the only assured backstop to achieving optimal results for my clients when the chips are down, I have always enjoyed resolving clients’ matters through negotiating with the parties and lawyers on the other side of our cases — sometimes, in a particular case, with the aid of a skilled mediator who is often a retired Virginia judge.

These forms of resolution of family law cases get people closer to what they want to achieve in the end than anything that a regular judge in court may do and, also, without those regular judges being hampered by the many restrictions imposed on them by Virginia law that most people are unaware of. There is definitely a time and a place for courtroom work, but many cases never need to see the inside of a courtroom and shouldn’t; their interests will be best served by first committing themselves to a fair settlement of their marital issues through negotiation, mediation, and the collaborative practice of law.

The collaborative practice of law allows, perhaps, the greatest flexibility for clients over litigation and the other litigation alternatives because it allows our clients who are at the heart of their matters to make creative decisions that will work best for themselves and their entire families. I believe that being in control of such decisions is best for changing family dynamics and allows the parties to move forward with their lives with the feeling that they have had control over the entire process and, especially, their outcomes at this very difficult time in their lives.
